3 Things You Should Have in Your Affiliate Program Terms and Conditions

[vc_row][vc_column][vc_column_text]We been launching and growing affiliate programs since 2004 with over 100 under our belts.  I lost count at that point.  With so many different organizations and advertisers, we see a lot of affiliate agreements come across our desk.  I asked my staff what 3 things they feel are important to include in any terms and conditions. Here are some of their answers:

Geoff Marshall

  • Paid Search
  • Special policies that are unique to the advertiser (consignment products, commission schedules, shipping)
  • FTC regulations and how to comply

And there you go!  If you don’t have items like the above, especially the FTC affiliate ads guidelines, you are not taking care of your company’s, and in some cases your own, liability.  Other items such as coupon and search policies will better enable your affiliates to fully understand what you want them to do and what you don’t want them to do.  But you just can’t stop there.  Having a great T&C’s is half the battle, you then have to ensure that your affiliate partners know about these items and you have to professionally enforce them.
